A board of education is the creation of the State Legislature and derives its authority to manage and operate the public schools of the district from the State General Assembly. A board of education not only has the authority but also the legal responsibility for the management and control of the school’s employees and students of the district. The members comprising the board of education have no authority to act except as a board, when together in a session, and then as a body or unit by resolution or motion.

Members of the board of education must be qualified electors and residents of the state for one year and of the school district for at least 40 days. Board of education members are selected on a nonpartisan ballot for a period of four years.

A board of education meeting is an official business meeting of the duly elected members of the board of education. The board meeting is the time for planning, for adoption of school policies, and the appraisal of the school system.
